YOUNGSTOWN — Marucci & Gaffney Excavating Co. has dismissed the civil lawsuit it filed against Youngstown State University last month over a contract the company was not awarded to build an asphalt surface parking lot on campus.

Attorneys for the construction company filed a notice of voluntary dismissal last week in Mahoning County Common Pleas Court, stating the lawsuit is moot because YSU issued a letter notifying the company YSU was rejecting all bids and “would no longer be awarding the project to Steel Valley Contractors.”

According to the lawsuit, the university awarded a contract to Steel Valley Contractors of Youngstown to build the Arlington Parking Facility to replace the former parking deck on Fifth Avenue “in violation of competitive bidding laws and YSU’s request for proposals.”

Ron Cole, public information officer YSU, did not respond to a request for comment.

The lawsuit’s goal was to stop the university from awarding or executing the contract, the suit states.

One day after the lawsuit was filed, Judge Anthony D’Apolito approved a temporary restraining order in the case.

The lawsuit asked for a temporary, preliminary and permanent injunction preventing the university from awarding a contract to Steel Valley Contractors or any other entity, preventing it from performing any work on the project and preventing YSU from making any payment to Steel Valley Contractors for work on the project.

It also asked the court to issue a declaratory judgment indicating that YSU’s decision to award the contract to SVC “constitutes an abuse of discretion” and that YSU violated state bidding laws.
